Council

By-Laws

By-Laws are supplementary legislation set by local governments to manage, control and regulate activities within the boundaries of a Council. The power of Councils to set By-Laws is given under the Local Government Act 1999.

The Council’s By-Laws do not replace or override existing state legislation, but are additional and often relate to various matters of the public interest.

Any person who commits a breach of a by-law is guilty of an offence under the Local Government Act 1999. Some offences are subject to the expiation fees set by Council in the annual Fees and Charges Schedule.

The City of Port Adelaide Enfield has eight By-Laws that were passed in July 2022 and made operational on 28 November 2022. A legislative amendment was required and passed on 13 June 2023 to introduce By-Law number 9 which amends the Local Government Land By-Law. The By-Laws are periodically reviewed by the Council and require support from a two-thirds majority of Elected Members to be passed.

"We acknowledge and pay respect to the Traditional Owners of the land on which we stand, the Kaurna People of the Adelaide Plains. It is upon their ancestral lands that the Port Adelaide Enfield Council meets. It is also the Place of the Kardi, the Emu, whose story travels from the coast inland. We pay respect to Elders past, present and emerging. We respect their spiritual beliefs and connections to land which are of continuing importance to the living Kaurna People of today. We further acknowledge the contributions and important role that Aboriginal and Torres Strait Islander people continue to play within our shared community."
